Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the www.hcgaragedoor.com and www.hcgaragedoor.ca website and accepting garage door installations or repairs (the "Service") operated by Hung Cheong ("us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
Content
Our Service entails a website with information about our garage door installation service, including materials, installations, repairs, photographs or other information ("Content") as well as physical installation and repair of garage doors ("Work"). Cost Estimates
Offers and cost estimates generated by Hung Cheong shall be made without commitment. Contracts shall be effective only if confirmed in writing by Hung Cheong or upon commencement of the work involved. Cost estimates by Hung Cheong shall be binding for the period specified only if submitted in writing and explicitly designated in the text to be binding
Terms of Payment
Hung Cheong enforces a 10% minimum down payment for Work to be performed. Down payment shall be paid by the customer at the time of acceptance of the order. If the customer cancels or refuses our service after Work has commenced, then we are entitled to keep the full down payment without refund or reimbursement. The remaining 90% of the cost of Work shall be paid in full at the day of Work completion in cash, cheques, or e-transfer. The customer shall not be entitled under any circumstances, in particular, due to alleged or actual deficiencies of work performed or parts delivered, to withhold or delay payments or part-payment of invoices for work performed and/or parts delivered by Hung Cheong.
Warranty
Hung Cheong warrants the proper execution of work and the absence of defects in functionality and quality in new parts installed or delivered in accordance with the specifications as set forth in the written contract or the acceptance of the order and with the state of the art and technology at the time of completion or delivery
The warranty by Hung Cheong shall be limited to the repair, replacement, or refund of faulty work or defective parts at the exclusion of any further statutory or other claims of the customer such as reduction of price, rescission or damages.
The warranty shall be valid for a maximum duration of 365 days from the date of completion of the installation or repairs to customer.
No warranty claim shall be admissible if the respective deficiency is a result of negligent acts or omissions by the customer or his employees or agents or is due to the non-compliance with applicable operating instructions, maintenance regulations by the customer, his employees or agents. In addition, no claims under warranty shall be admissible if the customer himself carries out, or causes third parties to carry out, work to repair deficiencies without prior written approval by Hung Cheong.
To the extent permitted by applicable law, there shall be no warranty whatsoever in connection with used parts or parts delivered by the customer or makeshift repairs installed or performed at the request of the customer. The warrenty is not applicable to work performed by subcontractors or installation of parts procured from third parties.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will notify the customer prior to pending Work. What constitutes a material change will be determined at our sole discretion.
